SWIFT24 User Agreement


Effective Date: December 12, 2024



Thank you for choosing SWIFT24. We want to change lives with trusted financial services that transcend borders. This User Agreement ("Agreement") is an agreement between SWIFT24 and you. This Agreement describes the terms of use that apply to your use of (i) SWIFT24 and websites in subdomains, (ii) the mobile applications (the "Mobile Apps"), which we provide under this User Agreement, and (iii) the services, content and other resources (collectively, our Mobile Apps and Websites, the "Services") provided or activated on our websites or mobile apps. This Agreement applies to U.S. SWIFT24 accounts only.

Please read this Agreement carefully. The terms of this Agreement are legally binding.



This Agreement governs your use of the Service and applies to all users who visit or access the Service. By accessing or using the Service in any way, completing the account registration process, browsing the Website or downloading the Application, you are deemed to (1) have read, understood and agree to be bound by this Agreement, (2) be of legal age to enter into a binding contract with SWIFT24, and (3) represent that your use of the Service is not prohibited by the laws of the United States, your place of residence, or any other applicable jurisdiction. If you do not agree to be bound by the terms of this Agreement, do not use our Services. If you wish to terminate this Agreement after opening your SWIFT24 Account, please close your SWIFT24 Account.

This User Agreement ("Agreement") includes dispute resolution and binding arbitration provisions, class action waivers, and waivers of your rights to arbitration, which affect your rights in connection with SWIFT24 and your dispute with the relevant parties. Please review Section 19 below carefully.



Other agreements and policies that you must follow. In addition, by using our Services, you also agree to our (i) Privacy Policy, (ii) Electronic Signature Information Disclosure and Consent, and (iii) Cookie Policy.



Use of our services. To access certain features of the Service, you must register an account with the Service ("SWIFT24 Account"). To open an SWIFT24 account, you must provide us with an email address and create a password via the SWIFT24 website or mobile app. You may access your SWIFT24 account to use our Services, review your account transaction history, and perform other tasks until we have successfully completed the necessary steps to verify your identity. Learn more about how to create an SWIFT24 account below.

Account security. You may use the Services only for yourself. That is, you may not create SWIFT24 accounts for others or use the Services, and you may not share SWIFT24 account information with others, in particular SWIFT24 account passwords, to enable them to use the Services on your behalf. If you believe that someone else may have accessed your SWIFT24 account, you should notify us as soon as possible. We also never ask for your SWIFT24 account password. For details on how we collect, store and share your information, please refer to our Privacy Policy .

1. Information relating to this User Agreement


About Us We, together with our employees, directors, affiliates, successors and assigns, are a Delaware-based U.S. company headquartered in Seattle, Washington, also referred to in this Agreement as "SWIFT24," "we," "us" and "our."

Your introduction. In this Agreement, the terms "you" and "your" mean you, the SWIFT24 account holder and user of the Service.

SWIFT24 account. An SWIFT24 account is an account provided by SWIFT24 to allow a person residing in the United States to transfer money to someone in another country or region. For the avoidance of doubt SWIFT24 accounts are not debit accounts or any other "balance" type of accounts. SWIFT24 You cannot hold funds in your account.

You accept and agree to the terms of this Agreement (including all policies) if:

If you register for the Services through our website or mobile app SWIFT24, and if you accept an electronic version of this Agreement when an option is provided, and if you access, download and/or use the Services, and if you begin or intend to use our Services, we will deem your use of our Services to be your acceptance of this Agreement. By accepting this Agreement, you agree to comply with the following additional policies ("Policies").

SWIFT24 reserves the right, in its sole discretion, to modify this Agreement or the policies listed above, such as changing, adding or deleting any part of this Agreement at any time. We will notify you 30 days in advance if any changes give rise to any of your rights or increased liability under this Agreement. Your continued use of the Service after changes to this Agreement are implemented will be deemed to be your agreement to and acceptance of those changes. You can review the most current version of the Agreement at any time in the User Agreement on our Website. If you do not modify this Agreement and attempt to modify it, you must agree to invalidate it.

2. Service


Users registered with the Service may make international remittances through the Service to recipients in other countries where the Service is provided by SWIFT24 in the United States. A list of countries where SWIFT24 can complete a transfer can be found on our website and mobile app. SWIFT24 reserves the right to suspend, temporarily or permanently, the provision of money transfers to all countries at any time without notice to you.

"Sender" means sending money using the Service and "Recipient" means receiving money through the Service. "Transaction" means a Sender's order that instructs us to send money to the Recipient through the Service. "Transaction Amount" is the U.S. dollar-based amount that the sender sends to the recipient SWIFT24 for remittance. "Payment amount" is the amount paid to the recipient.

This service should only be used to send money to someone you know and trust, such as family or friends. Do not use the Service to send money to someone you do not know, know or trust.

SWIFT24, Inc. is an authorized wire transfer provider throughout the United States. Additional information about SWIFT24's wire transfer license can be found on the main license page of our website. SWIFT24, Inc. is not licensed to provide the Services outside of the United States. Therefore, you may not be able to use the Service in countries other than the United States.

3. Service Start and Use


Create an account. You must create an SWIFT24 account to use the Service. SWIFT24 In order to create an account and use the Services, you may need to provide us with your information, including but not limited to your name, address, email address, telephone number, street address, postal code, date of birth, social security number or government-issued identification. We may record certain information about you through your SWIFT24 account as described in our Privacy Policy. SWIFT24 To create an account, you must be responsible for:

a. Provide complete, accurate and truthful information requested from us. The information you provide will also be used to determine if you are eligible to use our services.

b. Generate a security credential, such as a password or personal identification number, as deemed necessary by SWIFT24 (* "Security credential").

c. You must also provide information about any means of payment, such as a bank account, debit card or credit card (each individually and collectively, the "Payment Method"), where appropriate to make payment through the Services. When you provide us with your payment method information for the purpose of using the Service, you SWIFT24 agree to keep that information on file so that it can be used for funds transfers. You also represent and warrant that:

i. The means of payment are valid, have not expired, and are in good condition.

ii. You are an authorized and legitimate user of that means of payment.

iii. Each transaction you request through the Services is subject to this Agreement and any applicable laws, regulations and rules.

and

d. take such other steps as we or our third party service providers may reasonably require for your access to and use of the Service.

SWIFT24 Account security. You are entirely responsible for protecting your security credentials. You must notify us of any unauthorized use of your password or SWIFT24 account or any other breach of security by contacting us through our Immediate Help Center.

You must use our services only for yourself. You must not create SWIFT24 accounts or submit transactions on behalf of others. Our services under this Agreement are provided to consumers only. This means that individuals can use it for personal, family or household purposes. If you use our Services under the terms of this Agreement for any other purpose, including business purposes, you are in breach of this Agreement. We reserve the right to terminate your SWIFT24 account at any time without any legal liability to you, or to suspend or discontinue our services provided to you, or to discontinue your use of our services.

4. Eligibility to use our services


Age and qualifications. You must be at least 18 years of age to create an SWIFT24 account or use the Service. SWIFT24 When you open an account, you indicate that you are at least 18 years old. You must be able to conclude a legally effective contract in accordance with the applicable law. Other restrictions may apply.

residents of the United States. This service is only available to U.S. residents. If you reside outside the United States for a long time, we may temporarily suspend your access to the Services.

Proposal and acceptance. When you submit a transaction, you will ask us to process the transaction. These are offers that we may accept or reject at our sole discretion.

Revenge account. You can only have one active SWIFT24 account. If we determine that you are using multiple SWIFT24 accounts, we have the right to merge or delete more than one SWIFT24 account, limit your use of the Services, or temporarily suspend your use of your Remtily account.

5. Identity verification


Ordinary. To maintain the security of our systems under state and federal law, we are required to verify your identity and to retain certain information you provide to us in accordance with our Privacy Policy.

Customer identification requirements. In order to comply with our obligations under applicable anti-money laundering and anti-terrorist financing laws, we may need to collect, verify and record identifying information about you. In order to comply with our legal and regulatory obligations, we may require you to provide us with personally identifiable information that is not disclosed. We may also lawfully collect information about you from other sources.

Approval. If we believe it is reasonably necessary to verify the information provided to you, you must grant us the right to contact you and others. We reserve the right to ask you for additional information to verify your identity through third party databases or other sources and to ask you to take steps to verify your email address or ownership of your means of payment.

6. Transaction Transfer


Ordinary. SWIFT24 Accounts allow you to send money to the recipient by providing us with information about you and the recipient. You can send money to the recipient and the recipient can receive the funds you send even if they do not have an SWIFT24 account or do not use the Service.

transaction processing. When you submit a transaction, you ask us to process that transaction. In order for you to initiate a transaction through the Services and for us to process the transaction on your behalf, you must provide us with information about the valid means of payment you wish to use to fund the transaction through your SWIFT24 account. If you are unable to process a transaction using your chosen payment method, we will notify you and ask you to complete the transaction by choosing another payment method. You agree that we may accept or decline your offer to process transactions in accordance with the terms of this Agreement. For example, if you breach any obligation set forth in this Agreement, we are under no obligation to execute the transaction you have requested.

Bank account payment approval. If you use a bank account as a means of payment to procure transaction funds or pay a service fee, you agree to initiate an ACH withdrawal or deposit into that bank account in accordance with the payment instructions you provide and authorize the deposit of funds into that bank account for any refundable, cancelled or otherwise refundable transaction.

Card payment approval. If you use a credit or debit card to finance a transaction or pay a service fee, you authorize us to withdraw or charge for that payment method in order to finance the transaction in the amount you specified for the purpose of processing the transaction and the sum of the service fee, and to transfer such funds to the designated recipient immediately upon receipt of the transaction. You may withdraw the permission you have granted us to charge your debit or credit card by deleting it from your SWIFT24 account. If payment fails, you authorize us to try again more than once using the same debit or credit card, if any restrictions under applicable law apply.

Responsibility of SWIFT24. If you submit transaction details for transaction processing through our Services, you may not be able to change them, so it is your responsibility to ensure that all transaction details are complete, accurate and correct (including but not limited to the recipient's information and the recipient's bank or other account details).

To the extent permitted by law, you agree to be bound by any payment instructions or transactions initiated from your SWIFT24 account through the Service. You must ensure that all payment instructions for the transaction are correct and accurate.

You are entirely responsible for entering the correct information about the recipient you wish to send. As you have entered information relating to the recipient of the transaction incorrectly, you are responsible for the amount you have transferred to the wrong person, not in accordance with applicable law SWIFT24.

Where limitations under applicable law apply SWIFT24 shall not be liable for failure to complete a transaction in the following circumstances:

if your payment instructions contain inaccurate instructions, errors or insufficient information; or
If you do not have sufficient funds in your chosen payment method to pay for a transaction you initiate through the Service

7. Payment of service cost


Service fees. In return for providing our Services, you agree to pay us a service fee ("Service Fee") for each transaction you submit in addition to the transaction amount. Details of the individual service fees associated with a particular transaction can be found on our mobile app or website before you consent to the execution of the transaction. At the time you submit your transaction for processing, you must pay us in US dollars. Service fees may vary and may vary depending on the recipient country and other factors.

Other fees. We are not responsible for any fees charged by the financial institution associated with your means of payment. For example, some credit card issuers may treat the use of a credit card service as a "cash service" and may charge additional fees and interest charges for the transaction. SWIFT24 is not responsible for any outstanding fees ("NSF Fees"), cancellation fees or other similar charges that may be imposed on you by your bank, credit card issuer or other provider. If the means of payment are not used in the approved manner, or if you submit a transaction to SWIFT24 for which fees or other amounts are charged due to lack of funds or credit, we will notify you of the fees charged and you agree to pay us the corresponding amount.

Foreign exchange. We and our service providers (as defined below) may make a profit from the difference between the exchange rate at the time we purchase the foreign currency when you pay for a transaction in one currency and the exchange rate provided to you at the time of the transaction. Exchange rates may vary and may change depending on the recipient country and other factors. If a foreign exchange rate is applied to the transaction you request, it will be disclosed to you before the transaction is approved.

Third party fees and charges. When you use our Services, other third parties may charge you fees, costs or other liabilities. These third parties may include your bank, card issuer, carrier or Internet service provider. For example, a carrier and/or Internet service provider may charge fees in connection with data or message services. Any fees, charges, costs and/or expenses charged by such third parties in connection with your use of our Services are your responsibility, not SWIFT24. For details on these additional costs, please refer to your contract with the respective third party provider.

8. Receiving Remittances


Service Providers. We cooperate with your local bank and other third party vendors (each a "Service Provider") to pay the transfer amount to the recipient. We strive to provide up-to-date information on the location, availability and opening hours of our service providers on our website. This information may be changed unintentionally by us and we will not be liable for any inaccuracy or incompleteness of the information posted on the Website.

Confirm the recipient. The recipient may be required to provide our service providers with information such as a valid ID to verify their identity before receiving the funds. The recipient may also be required to provide a reference number or other similar ID associated with the transaction.

expired transaction. We will cancel the transaction in which the funds are provided to the recipient via cash pickup if they are not properly withdrawn within 60 days of the date the funds were first provided. To the extent possible for such expired transactions, we will refund the full transaction amount, taxes and service fees paid by you as part of the transaction. If the funds cannot be returned by this means of payment after the legally required time has elapsed, the funds will be returned to that week.

9. Important Service Limitations


Our right to limit your use of our Services. In addition to the limitations described elsewhere in this Agreement, we may, in our sole discretion, refuse to process a transaction if we reasonably believe or have reasonable grounds to believe that it is necessary to protect you and/or us, or if otherwise required to comply with any legal or regulatory requirement. You agree that we may limit the amount of money transferred individually or in its entirety. These restrictions may apply to individual SWIFT24 accounts or specific means of payment for SWIFT24 accounts. We also reserve the right to modify or discontinue all or part of the Service at any time.

Delay. We have sole discretion to delay your transaction in accordance with applicable law for identity verification, means of payment verification, our financial risk management or if we believe that a transaction may involve fraud or a crime or a violation of any law, rule or regulation has occurred, is occurring or is likely to occur. You may receive a refund or other remedy under certain circumstances, depending on the reason for the failure to provide funds to the recipient or the delay.

Time it takes to transfer money. The transfer time information or estimated value of a transaction provided on our website or mobile app is SWIFT24, an estimated delivery date and time based on our partners and service providers' payment methods, Indian methods, transaction reviews and system availability. In addition to the transfer time and estimate information we provide during the transfer process, we will notify you of the exact date and time the funds will be delivered to the recipient via a transaction receipt before submitting the transaction.

Commercial deals. We are not responsible for the quality or delivery of any goods or services you have paid to the recipient using the Service. You agree that it is your responsibility to use the Service to transfer funds to pay for goods and services.

Reason for failure. In order to comply with applicable laws and regulations, we may refuse transactions with certain senders and recipients included in the Specially Designated Country Nationals and Blocked Persons List, Non-Cooperating Country and Territory List, and other lists compiled by other government agencies.

Change is prohibited. We generally do not allow the details of the transaction to change after the transaction has been submitted for processing. It is your responsibility to write down your transaction details accurately. You shall be responsible, not SWIFT24, for any misinformation or error that occurs when entering information about the Transaction Recipient in accordance with Section 6.5 and other sections of this Agreement. However, nothing in this Agreement shall be construed as limiting your rights under applicable law to cancel a transaction or make false claims in connection with a transaction.

prohibited activities. In connection with your use of our website or services, or in the course of your interaction with us SWIFT24, we treat the following as prohibited activities (each a "prohibited activity"), and you will not:

Violation of this Agreement or any other agreement entered into between you SWIFT24use our Services for any unlawful purpose or in violation of any applicable law affecting us or your use of the Services (including, but not limited to, fraud, terrorist organization financing and/or money laundering); Use of the Service for the purchase or sale of sexually explicit content or services, gambling, fraud, money laundering, terrorist organization funding, tobacco or tobacco-related goods, ammunition, prescription drugs or other regulated drugs Provide information that is materially false, inaccurate or misleading (including, but not limited to, information that is part of the SWIFT24 account creation process and/or information requested from you to execute a transaction) refuse to provide you, your identity or any additional information or confirmation regarding your use of our Services that we may request or to cooperate with an investigation; Using an anonymous proxy Using a credit card as a means of using cash services (or assisting others in doing so) Receive or attempt to receive a refund or other refund for the same transaction from us, other users of our Services, banks or debit or credit card issuers in order to obtain more funds than you may receive in the course of a dispute The use of robots, spiders, scrapers, automated devices or manual processes SWIFT24 to monitor or copy our website or app, or to display, use, copy or modify intellectual property in any other way SWIFT24, has the right, in its sole discretion, to take the following actions if we determine that you are engaged in a prohibited activity or that you may have been engaged in a prohibited activity.

Delay, cancel, cancel, refuse or refuse transaction processing and/or modify transaction information (or take similar action through another payment service provider) SWIFT24 Restricting your use of our Services, in whole or in part, including closing or suspending your account, temporarily or permanently suspending your use of certain means of payment for our Services, and/or not providing the Services to you in the future Refuse to edit, modify or publish content and/or refuse to perform payment instructions in connection with prohibited activities Reporting transactions and other relevant information about you and your use of the Services to our financial institution partners, regulators, police or other law enforcement agencies and/or government departments or agencies If we temporarily suspend your use of our Services, refuse to perform payment instructions, or otherwise limit your use of the Services, we will try to notify you by electronic or other means as permitted by law.

10. Country Terms


deal with India. SWIFT24 handles transactions with India in accordance with the Rupee Withdrawal Regulations ("RDAs") set forth by the Reserve Bank of India. You are prohibited from using the Service for any commercial purpose or from using it to donate to a charitable organization under this Agreement. You agree to provide any relevant documentation, support or (in the form requested) co-operation to a remittance service provider, audit authority or inspection authority to perform any necessary inspections, including customer verification inspections, as required by applicable law.

deal with Brazil. If you use our services to send money to Brazil in Brazilian helo and we conduct transactions through our Brazilian licensed entity (SWIFT24 Corretora de Cambio Ltda), the terms of this Brazilian Additional Provision will apply to your transaction. Please read the Brazil Additional Provisions carefully.

11. Communications and Devices


To transfer transactions through your SWIFT24 account, you must provide your mobile phone number and email address to SWIFT24. By using the Service, you declare ownership of your email address and mobile phone number.

By providing us with your mobile phone number and email address, you agree to receive SWIFT24 account or SWIFT24 transaction-related phone or text (SMS) messages and push notifications from us in connection with the transaction and the account. We may contact you by telephone or text, including, but not limited to, notifications regarding receipts of transactions and account updates, for the purpose of complying with the terms of this Agreement and our Privacy Notice. Depending on your contract with your mobile carrier, standard message and data charges may apply.

SWIFT24 It is important to keep your email and phone numbers up to date on your account, and you must comply with this. You should also check emails regularly to ensure that you do not miss out on your transaction or emails about our services SWIFT24. SWIFT24 is not responsible for any loss or other consequences if you do not check your email regularly.

12. Troubleshooting, Cancellation and Refund


Troubleshooting. You have the right to object to a transaction error. If you believe there has been an error in the transaction or you are not satisfied with the service

You must contact us by the following means within 180 days of the date you submit your transaction:

Cancellation. You can cancel at any time before the transaction is completed. Transaction completion means that your recipient has picked up the funds you sent for cash pickup or that the funds have been deposited into the recipient's bank account at the time of your cancellation request. Upon receipt of a cancellation request, we will verify that the transaction has been completed. This may include contacting our service provider to verify that the transaction has been completed before starting the refund. SWIFT24 ability to suspend or cancel a transaction depends on the method you choose to pay the funds to the recipient and the time you submit your cancellation request. If you can cancel a transaction, we will refund you the transaction amount, taxes and service fees charged to you as part of the transaction. The transaction amount is non-refundable upon completion of the transaction.

No delivery deal. We may determine that we are unable to complete the transaction due to your mistake or a problem with the information you have provided to us, or our partners may notify us. In such cases, we will notify you that we are unable to complete your transaction and ask you to correct the information you have provided to us and to resubmit the transaction. We reserve the right to cancel a transaction if you fail to take action to correct any error or transaction-related issue within 72 hours. If you cancel a transaction with us without taking steps to correct the error or problem, we will refund the full transaction amount, taxes and service fees paid by you as part of the transaction.

Refund.

a. Please refer to the SWIFT24 Troubleshooting and Cancellation Disclosure for information on the steps to be taken if you believe there has been an error in the transaction, as well as the amount of the transaction and the circumstances in which the respective fees and taxes may be refunded to you. SWIFT24 determines that you may receive a refund for a particular transaction in accordance with our obligations under applicable law or otherwise, we will refund the full transaction amount, taxes and service fees you paid as part of the transaction.

b. All refunds will be paid by the same means of payment used for the transaction. Refunds are paid in US dollars only and no adjustment applies to changes in the value of US dollars or foreign currencies since the time the transaction was submitted. If the means of payment you used to pay for the original transaction are no longer valid and we cannot find a mutually acceptable solution, the refund may be delayed until we can process the refund in a commercially reasonable manner.

c. Strict delivery warranty commitment. We will notify you of the exact date and time when the funds will be delivered to the recipient via the transaction receipt before submitting the transaction. If funds are transferred after the date and time indicated prior to the transfer and the date and time indicated on the receipt, you may receive a refund of the service fee charged for the transaction. To receive a refund of the service fee, you must contact us using the methods below to request a refund of the service fee charged for that transaction.

13. State-by-state refund rights and procedures



Residents of certain jurisdictions may have certain refund rights and filing procedures under state remittance laws in addition to their rights under federal law as described in this section. Information on the state-by-state refund rights and their filing procedures can be found here . Texas. If the sender resides in Texas, you are entitled to receive the receipt, cancel the transaction within 30 minutes and receive an immediate refund of all amounts charged to the transfer, including any fees paid to SWIFT24. The exception is, however, if the recipient of the transaction has received the amount of the remittance or compliance with it. Submission of each state. If you have any concerns or questions about our Services, such as your SWIFT24 account or specific transactions, we encourage you to share them with us, but you may also contact the authorized remittance authority in your state of residence. 14. Term and Cancellation


Term of this Agreement. This Agreement begins at the time you agree to the Agreement as described in the Policy. This Agreement shall be in effect until terminated in accordance with the terms of this Agreement.

SWIFT24 may terminate this Agreement. We may also terminate this Agreement at any time for any reason by giving you at least 15 days' notice. We may terminate this Agreement immediately if you breach these Terms or any of our prohibited activities, including our policies.

SWIFT24 What happens if my account is closed or this Agreement is terminated? SWIFT24 If your account is closed or this Agreement is terminated, you agree to the following:

Terminate your use of our Services immediately. The license granted under this Agreement shall terminate. We reserve the right to retain such information in accordance with our record-keeping obligations under applicable law, but we also have the right to delete all your information and account data stored as part of your use of our Services. We will not be liable to you or any third party for any termination of your access to our Services or deletion of such information or account data. Fees. Notwithstanding any termination of this Agreement, your obligation to pay any service fees or charges you may have paid prior to such termination and any other amounts you may have paid under this Agreement shall not disappear.

Existence. Even after the termination of this Agreement, any portion of this Agreement reasonably necessary to achieve or enforce the purpose of this Agreement will continue and remain in effect in accordance with those terms upon termination of this Agreement.

15. Intellectual Property of License, SWIFT24


access to services. You are always granted the right to access and use the Services to which this Agreement applies.

Application License. If you comply with this Agreement SWIFT24, we grant you a non-exclusive, non-transferable, non-sublicensable and revocable limited license to download, install and use copies of the Mobile App on a device you own or manage and to run copies of the Mobile App for your own internal purposes only.

Ownership. Copyright, trademarks, logos, and product and service names, including the Website Content, text, graphics, logos, and images, are the exclusive property of SWIFT24, Inc. ("SWIFT24 Intellectual Property").

use. You agree not to display, use, reproduce or modify SWIFT24 Intellectual Property in any way. You are only permitted to view and retain a copy of this website page for your personal, non-commercial use. In addition, you agree not to (i) access the Service using a robot, spider, scraper, or other automated device, or (ii) remove or modify any author, trademark, or other proprietary notices or practices displayed on this Website (or any printed Website page), or (iii) infringe any copyright, patent, trademark, trade secret, or other intellectual property, copyright, or privacy right of SWIFT24 or any third party.

Feedback If you provide suggestions, feedback, reviews or opinions relating to our Services ("Customer Feedback"), we own all rights, title and interest in and to such Customer Feedback, even if you have designated such Customer Feedback as confidential. We reserve the right to use customer feedback for any purpose, including, without limitation, marketing and business purposes. You must assign to us all rights, title and interest in Customer Feedback and agree to provide us with all necessary assistance in recording, determining and maintaining our rights in Customer Feedback. In this case, "transfer" is a legal term meaning that the interests are legally transferred. For example, you are legally transferring an interest in customer feedback to us.

16. Disclaimers, Limited Warranties and Remedies


You expressly understand and agree that, to the maximum extent permitted by applicable law, your use of the Service is entirely at your own risk and that the Service is provided "as is" and "as available", including any defects. SWIFT24 EXPRESSLY DISCLAIMS ALL WARRANTIES, REPRESENTATIONS AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT ARISING FROM THE USE OF THE SERVICE. Some jurisdictions do not allow the disclaimer of implied warranties, so if you reside in that jurisdiction, the above disclaimer may not apply to you. You may be entitled to a refund or other remedy as expressly described in this Agreement or by applicable state or federal law. If the payment amount is not paid to the recipient by the available date indicated on the transaction receipt under federal law, you may notify SWIFT24 of the issue using the troubleshooting procedure described in Section 12 above, and you have the right to seek remedies under federal law, including a refund of service fees.

17. Disclaimer


Except to the extent set forth in the Electronic Funds Transfer Act and its regulations E, 12 C.F.R. § 1005.1 (see below), you agree to indemnify and hold harmless SWIFT24, the Service Provider, and each of its subsidiaries, officers, agents, partners, and employees, from and against any claim or demand (e.g., reasonable attorneys' fees) made by any third party in connection with your use of the Service, your relationship with the Service, your violation of this Agreement or your violation of any rights of another.

18. Limitation of Liability


TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SERVICE PROVIDER OR ANY SUBSIDIARIES, OFFICERS, AGENTS, PARTNERS OR EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES EXCEEDING $500.00 (AND THE TRANSACTION AMOUNT AND SERVICE FEE REFUNDS) FOR ANY LOSS OF PROFITS, PROFITS, LICENSES, DATA OR OTHER INTANGIBLE LOSSES ARISING OUT OF THE FAILURE OF ANY SUBSIDIARIES, OFFICERS, AGENTS, PARTNERS OR EMPLOYEES. The same applies if SWIFT24 has advised of the possibility of such damage. For the avoidance of doubt, the foregoing does not limit your right to monetary relief under 15 U.S.C. § 1693m(a).

19. Dispute Resolution and Arbitration Agreements


Disputes with SWIFT24 This section affects your rights, so please read this Agreement carefully before agreeing.

"Claim" as used in this Agreement includes any past, present or future claim, dispute or controversy between you SWIFT24 arising out of or relating to this Agreement and/or any activity or relationship arising out of or arising out of this Agreement.

If you believe that either you or SWIFT24 can claim against each other, you and SWIFT24 agree to informally discuss the claim for 60 days to see if it can be resolved. During this period, you and SWIFT24 agree to terminate such action. This 60-day period begins with sending a notice of claim to the other party, which should include a brief description of the claimed claim and the facts and laws supporting the claimed claim. You agree to send notice to us at Attn: Legal, 401 Union Street, Suite 1000, Seattle, WA 98101. SWIFT24 will notify you of the claim by sending an email to the email address provided in the profile section of your SWIFT24 account if it believes that SWIFT24 may charge you.

If you and SWIFT24 are unable to resolve the claimed claim within 60 days of receipt of the notice of claim, the claiming party may initiate arbitration or small claims proceedings as described below.

You and SWIFT24 agree that sending a notice of claim and participating in the informal dispute process described above is a prerequisite for initiating arbitration or small claims proceedings. Failure to comply with the Notice of Claim requirements may result in arbitration or small claims being dismissed.

Arbitration has no judge or jury, and court review of arbitral awards is limited by the Federal Arbitration Act, 9 U.S.C. § 1 et seq. However, the arbitrator may individually determine the same damages and remedies as the court (including injunctive and declarative remedies or judicial damages) and must abide by the terms in the same way as the court. For the avoidance of doubt, the arbitrator may decide on a public injunction remedy if it is approved by law and guaranteed by an individual claim.

Claim Court. If a court determines that this Section 19 cannot be enforced, you and SWIFT24 agree to resolve a claim in a state or federal court located in or around King County, Washington. You and SWIFT24 agree to submit to the exclusive jurisdiction of the state and federal courts located in and around King County, Washington, to bring any and all such claims.

Possibility of Separation of Arbitration Clauses. If the arbitrator determines that 19.2.B (waiver of arbitration and class action waiver) is unenforceable or invalid, this Section 19 in its entirety shall be severable from the Agreement and the Agreement shall be enforced as if not covered by this Section 19.

20. by law.


Except as provided in Section 19, in the event of any dispute over the meaning of this Agreement, you and SWIFT24 agree that this Agreement shall be governed by the laws of Washington, D.C., and that all claims shall be settled in accordance with the laws of Washington, D.C., other than those governing international law, and that all activities performed in connection with the Services shall be deemed to have been performed in Washington.

21. Other


1. Full agreement. This Agreement constitutes the entire agreement between you and SWIFT24 and supersedes all prior agreements between you and SWIFT24 governing your use of the Service.

2. Non-waiver of rights. Failure by SWIFT24 to exercise or enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision. Even if any provision of this Agreement is held to be invalid by an arbitrator or court of competent jurisdiction, the parties agree that such arbitrator or court shall endeavour to give due effect to the intent of this Agreement as reflected in that provision and to maintain the full force and effect of the other provisions of this Agreement.

3. Impossible. Except to the extent required by applicable law in connection with an already accepted transaction, we will not be liable for any failure or delay in the performance of the Service if such failure or delay is due to a cause beyond our reasonable control. Corresponding causes include revision of relevant laws, closure/shutdown of essential physical and network infrastructure, national debt, power outages, Internet disruptions, social unrest, war, earthquakes, fires, floods, and other natural disasters.

4. Other Terms. This Agreement may be supplemented by other terms applicable to other promotions, referral programs and other terms applicable to your use of the Services. These Terms are incorporated by reference into this Agreement. If any of these terms are found to be in conflict with this Agreement, this Agreement shall prevail.

22. Language


This Agreement is written in English and translations into other languages may be provided. You must agree that in the event of any dispute relating to this Agreement any discrepancy is found between the English language and the translation, the English version of this Agreement shall prevail.

23. Third Party Services.


Third-party websites, applications and advertisements. The Services may include links to third-party websites ("Third-Party Websites"), applications ("Third-Party Apps") and third-party advertisements ("Third-Party Advertisements") (collectively, the Third-Party Services). By clicking a link to a third-party service, we do not warn you that you have terminated the service and that the terms of use (including the privacy policy) of another website or destination apply. These third-party services are not controlled by SWIFT24. SWIFT24 is not responsible for third party services. SWIFT24 provides such third-party services for convenience only and does not review, endorse, monitor, endorse, warrant or make any representations with respect to such third-party services or any goods or services offered in connection therewith. You use all links to the Third Party Services at your own risk. Upon termination of our Services, this Agreement and our policies will no longer apply. You should review the relevant terms and policies, such as the privacy and data collection practices of the Third Party Services, and conduct any investigation you deem necessary or appropriate before entering into any transaction with the Third Party.

Sharing information through third party services. SWIFT24 may provide you with tools to export information to third-party services through the Services. By using any of these tools, you agree that SWIFT24 may transmit such information to that third-party service. SWIFT24 is not responsible for the use of your exported information by third party services.

Third party application access. With respect to any app accessed or downloaded through the Apple App Store ("App Store Provided Apps"), you must use the App Store Provided Apps only as permitted by the "Rules of Use" set forth in the Apple Media Terms of Service on (i) Apple-branded products running iOS (Apple's exclusive operating system). However, the app provided by the App Store may be accessed, acquired, and used from another account associated with the Buyer through Apple's Family Sharing, Bulk Purchasing, or Heritage Manager features. Notwithstanding the first sentence of this section, with respect to any app you access or download through the Google Play Store (Apps provided by Google Play), you may have additional license rights in connection with the use of third-party apps on a sharing basis within your designated family group.
